1. General provisions
1.1. These Terms and Conditions set out the rules for the use by Users (Buyers) of the website https://oxygenbotanicals.pl/ (hereinafter: the “Service”, the “Website”, the “Online Store”).
1.2. These Terms and Conditions constitute the online store regulations within the meaning of Polish law, in particular the Civil Code and the Act of 30 May 2014 on Consumer Rights, and are addressed to an unspecified group of recipients.
1.3. Use of the Service means acceptance of these Terms and Conditions in their entirety.
1.4. The administrator of the Service (hereinafter: the “Administration”) is the owner (seller) of the website https://oxygenbotanicals.pl/. The Administration reserves the right to amend these Terms and Conditions at any time. Amendments take effect upon publication on the Website.

1.5. The Buyer is obliged to read these Terms and Conditions before placing an Order.
1.6. If the User does not accept these Terms and Conditions, they should stop using the Service.
2. Registration and user account
2.1. An Order may be placed after creating a user account or without registration.
2.2. When registering, the Buyer must provide true, current and complete information.
2.3. The account login is the Buyer’s email address. The Buyer bears full responsibility for the security of their password and for any actions performed using the account.
2.4. The Administration is not liable for the consequences of sharing login details with third parties.
3. Personal data protection (GDPR)
3.1. The controller of the Buyers’ personal data is the Administration of the Service.
3.2. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and applicable Polish law.
3.3. Personal data is processed for the purposes of fulfilling Orders, customer service, meeting accounting obligations and – subject to the Buyer’s separate consent – for marketing purposes.
3.4. Providing personal data is voluntary but necessary to conclude a sales contract.
3.5. The Buyer has the right to access, rectify and erase their data, to restrict processing, to data portability and to object.
3.6. Personal data may be transferred to third parties only to the extent necessary to fulfil the Order, in particular to payment operators and courier companies.
3.7. The Service uses cookies in accordance with the Privacy and Cookie Policy.
4. Placing orders and performance of the contract
4.1. Orders can be placed through the Service 24 hours a day.
4.2. After placing an Order, the Buyer receives an electronic confirmation.
4.3. The sales contract is concluded when the Order is confirmed by the Administration.
4.4. Prices shown in the Service are gross prices (including VAT) and are expressed in Polish zloty.
4.5. The Administration reserves the right to cancel an Order if the Goods are unavailable.
4.6. Available payment methods include electronic payments processed by the operator PayU, including BLIK.
4.7. Fulfilment of the Order begins once the Seller receives confirmation of payment.
4.8. Goods are delivered only within the territory of the Member States of the European Union.
4.9. Delivery is carried out by courier companies and logistics operators, in particular InPost, DHL, UPS and Pocztex.
4.10. The Seller does not offer personal collection.
5. Right of withdrawal and complaints
5.1. A Consumer has the right to withdraw from a distance contract within 14 days of receiving the Goods, without giving any reason, in accordance with the Act on Consumer Rights.
5.2. The right of withdrawal does not apply to cosmetic Goods delivered in sealed packaging if the packaging has been opened after delivery, for reasons of health protection or hygiene, in accordance with Article 38(5) of the Act on Consumer Rights.
5.3. Only unused, unopened Goods with an intact seal or hygiene protection, in their original packaging, may be returned.
5.4. The cost of returning the Goods in the event of withdrawal from the contract is borne by the Consumer. The Goods should be returned to the address from which the Seller dispatched them, unless the Seller specifies a different return address.
5.5. Complaints should be submitted electronically or in writing. The Administration processes complaints within 14 days.
5.6. The Seller is liable for the conformity of the Goods with the contract in accordance with the applicable provisions of the Act on Consumer Rights.
5.7. If the Goods are found not to conform to the contract, the Consumer may request their repair or replacement.
5.8. If repair or replacement proves impossible or would require excessive costs, the Consumer may request a price reduction or withdraw from the contract on the terms provided by law.
5.9. Complaints should be submitted electronically to: info@oxygenbotanicals.pl.
5.10. The Seller responds to a complaint within 14 days of receiving it.
6. Liability
6.1. The Administration makes every effort to ensure that the information published in the Service is up to date and reliable.
6.2. The Administration is not liable for interruptions in the operation of the Service resulting from technical reasons or causes beyond its control.
6.3. The Administration is not responsible for content posted by Users.
7. Copyright
7.1. All content published in the Service is the property of the Administration or third parties and is legally protected.
7.2. Copying, distributing or using the content without written consent is prohibited.
